Bakkie Guys (Registration No. 2026/654808/07) is an independently registered South African business.

These Terms and Conditions (“Terms”) govern your access to and use of the Bakkie Guys website, including purchases made through the website, marketplace listings, advertising services and interactions with participating sellers and suppliers.

By accessing, registering on, purchasing through, advertising on or otherwise using Bakkie Guys, you agree to these Terms.

If you do not agree with these Terms, you should discontinue use of the website.


2. About Bakkie Guys

Bakkie Guys operates using a hybrid marketplace and e-commerce model.

Products and services displayed on the website may fall into different categories:

Bakkie Guys Direct Sales: Certain products may be purchased and paid for directly through the Bakkie Guys website. These products may be stocked by Bakkie Guys or supplied and/or fulfilled by participating suppliers.

3. Products Sold Through Bakkie Guys

Where a product is available for purchase and payment directly through the Bakkie Guys website, the customer may place an order using the website’s checkout facility.

Products sold through Bakkie Guys may be:

  • Held in stock by Bakkie Guys;

  • Supplied to Bakkie Guys by a third-party supplier;

  • Shipped directly from a supplier to the customer;

  • Collected from a participating supplier or fitment centre; or

  • Fulfilled through another approved logistics arrangement.

The fact that a product is supplied or shipped by a third party does not necessarily mean that the customer is purchasing directly from that third party.

Where Bakkie Guys is identified as the seller, the customer’s transaction is with Bakkie Guys.


4. Third-Party Marketplace and Advertising Listings

Bakkie Guys also allows independent businesses and approved sellers to advertise products and services.

These businesses may include:

  • Bakkie accessory dealers;

  • Manufacturers;

  • Distributors;

  • Fitment centres;

  • Parts suppliers;

  • Automotive businesses;

  • Service providers; and

  • Other approved businesses.

Where a listing is provided for advertising, directory or lead-generation purposes only, Bakkie Guys is not the seller and is not a party to the transaction between the customer and advertiser.

Customers may be required to communicate directly with the advertiser to:

  • Request quotations;

  • Confirm product availability;

  • Confirm compatibility;

  • Place an order;

  • Make payment;

  • Arrange fitment;

  • Arrange delivery or collection; and

  • Resolve after-sales matters.

Any agreement concluded directly between a customer and an independent advertiser is between those parties.


5. Orders and Acceptance

Placing an order through the Bakkie Guys website constitutes an offer by the customer to purchase the relevant products.

An automated order confirmation does not necessarily constitute final acceptance of the order.

Bakkie Guys reserves the right to reject or cancel an order where reasonably necessary, including where:

  • A product is unavailable;

  • Stock information was incorrect;

  • A pricing or description error occurred;

  • Payment could not be verified;

  • Fraud or unauthorised activity is suspected;

  • The supplier is unable to fulfil the product;

  • Delivery cannot reasonably be arranged; or

  • The transaction would violate applicable law.

Where an order has been cancelled after payment has been received, any refund legally due will be processed using an appropriate payment method.


6. Pricing

Prices displayed on the website are stated in South African Rand (ZAR) unless otherwise indicated.

We take reasonable steps to ensure that pricing is accurate. However, errors may occasionally occur.

Where an obvious pricing error occurs, Bakkie Guys may contact the customer before fulfilling the order and provide the option to proceed at the correct price or cancel the affected order.

Prices may change without notice, but a price change will not ordinarily affect an order already accepted by Bakkie Guys.

Delivery, fitment or other charges may be charged separately where applicable and will be communicated or displayed before they become payable.


7. Payments

Products available for direct purchase through Bakkie Guys may be paid for using payment methods made available at checkout.

Payments may be processed by independent third-party payment service providers.

Bakkie Guys does not intentionally store customers’ complete credit or debit card information on its own systems.

An order may be withheld or cancelled where payment is declined, reversed, disputed, identified as potentially fraudulent or otherwise not successfully completed.


8. Product Availability

Products displayed on the website are subject to availability.

Because certain products are supplied or fulfilled by third-party suppliers, stock information may occasionally change before our website has been updated.

If a product becomes unavailable after an order has been placed, we may:

Customers are responsible for providing accurate vehicle information when purchasing compatibility-dependent products.

  • Model;

  • Model year;

  • Body type;

  • Engine or drivetrain;

  • Single, extended or double cab configuration; and

  • Other fitment information reasonably requested.

Customers should carefully review product compatibility information before ordering.

Where you are uncertain whether a product will fit your vehicle, we strongly recommend contacting Bakkie Guys or the relevant seller before purchasing.

Nothing in this section limits any rights a consumer may have under applicable South African consumer protection legislation.


10. Product Images and Descriptions

We take reasonable steps to ensure product descriptions, specifications and images are accurate.

Some information may be supplied by manufacturers, distributors or participating sellers.

Product images may be illustrative, and minor differences in appearance, packaging, colour or specifications may occur.

Material differences affecting the nature or intended use of a product will be handled in accordance with applicable consumer protection legislation.


11. Delivery

Delivery availability, charges and estimated delivery times may depend on:

  • Product size and weight;

  • Customer location;

  • Supplier location;

  • Courier availability;

  • Product availability; and

  • Whether specialist freight is required.

Delivery estimates are provided in good faith but are not guarantees unless expressly stated otherwise.

Certain oversized products, including canopies, bumpers, bull bars, roof racks and similar equipment, may require specialised freight or collection arrangements.

Where a supplier ships directly to the customer, necessary customer and delivery information may be shared with that supplier and/or courier for fulfilment purposes.

Risk, delivery and consumer rights will be determined in accordance with applicable South African law.


12. Fitment and Installation

Some products sold or advertised through Bakkie Guys may require professional fitment.

Unless expressly stated otherwise, the purchase price of a product does not include installation or fitment.

Where fitment is performed by an independent fitment centre or service provider, that provider is responsible for the workmanship and services it provides, subject to applicable law.

Customers should ensure that products requiring specialist installation are fitted by appropriately qualified or experienced persons.

Bakkie Guys is not responsible for damage resulting solely from incorrect installation performed by an independent third party where Bakkie Guys did not provide or arrange that installation, subject always to applicable law.


13. Returns, Refunds and Warranties

Returns, refunds, exchanges and warranties for products sold directly through Bakkie Guys will be handled in accordance with our applicable Returns and Refund Policy and South African law, including the Consumer Protection Act where applicable.

Different rules may apply depending on whether a product is:

  • Defective;

  • Incorrectly supplied;

  • Damaged;

  • Custom-made;

  • Specially ordered;

  • Incorrectly ordered by the customer;

  • Already installed or fitted; or

  • Subject to a manufacturer’s warranty.

Nothing in these Terms is intended to waive or restrict any statutory consumer rights that cannot lawfully be excluded.

For products purchased directly from an independent marketplace seller rather than from Bakkie Guys, the relevant seller is ordinarily responsible for returns, warranties and after-sales obligations arising from that transaction.


14. Seller Listings and Advertising Services

Businesses may purchase advertising, promotional and listing services from Bakkie Guys.

Advertising or listing fees do not guarantee:

  • Sales;

  • Customer enquiries;

  • Website traffic;

  • Search engine rankings;

  • Leads;

  • Revenue; or

  • Business growth.

Fees are payable according to the selected package, campaign or agreement.

Unless otherwise stated or required by law, advertising and listing fees are non-refundable once the applicable advertising service has commenced.


15. Seller Responsibilities

Businesses advertising or selling through Bakkie Guys must:

  • Provide accurate and truthful information;

  • Keep pricing and availability reasonably current;

  • Provide accurate product descriptions;

  • Avoid misleading or deceptive advertising;

  • Hold any licences, permissions or authorisations legally required for their activities;

  • Comply with applicable South African laws;

  • Respect customer privacy and personal information;

  • Honour applicable warranties and consumer rights;

  • Respond professionally to customer enquiries; and

  • Supply lawful products.

Sellers may not knowingly list counterfeit, stolen, prohibited or unlawfully obtained goods.

Bakkie Guys may request supporting documentation from sellers where reasonably necessary.


16. Seller Content

Sellers and advertisers retain ownership of photographs, descriptions, logos and other content they provide, subject to any third-party rights.

By submitting content to Bakkie Guys, the seller grants Bakkie Guys a non-exclusive, royalty-free licence to use, reproduce, resize, adapt, publish, display and promote that content for purposes connected with:

  • Operating the Bakkie Guys website;

  • Advertising the seller’s products or business;

  • Search engine optimisation;

  • Social media marketing;

  • Email marketing; and

  • Promoting the Bakkie Guys platform.

The seller warrants that it has the necessary rights or permission to provide and authorise the use of such content.


17. Listing Suspension and Removal

Bakkie Guys may suspend, reject, edit or remove listings where reasonably necessary, including where a listing:

  • Contains materially false or misleading information;

  • Violates applicable law;

  • Infringes intellectual property rights;

  • Advertises prohibited or unlawful goods;

  • Presents a security or fraud risk;

  • Breaches these Terms;

  • Has expired or remains unpaid; or

  • Could reasonably cause material harm to customers or the platform.

Where appropriate, we may provide the seller with an opportunity to correct a listing.


18. Buyer Responsibilities

Customers using marketplace or advertising listings should take reasonable steps to verify relevant information before entering into a direct transaction with an independent seller.

This may include confirming:

  • Product compatibility;

  • Current pricing;

  • Stock availability;

  • Product specifications;

  • Warranty terms;

  • Fitment requirements;

  • Delivery arrangements; and

  • The identity of the seller.

This section primarily applies to transactions concluded independently of Bakkie Guys and does not remove obligations that Bakkie Guys may have when Bakkie Guys itself is the seller.


19. Intellectual Property

The Bakkie Guys name, logo, branding, website design and original website content belong to Bakkie Guys or its applicable licensors.

This may include:

  • Logos;

  • Branding;

  • Website design;

  • Original text;

  • Graphics;

  • Layouts;

  • Software elements;

  • Databases and compilations; and

  • Original marketing material.

No person may reproduce, distribute, commercially exploit or misrepresent Bakkie Guys intellectual property without prior authorisation, except where permitted by law.

Third-party trademarks, vehicle manufacturer names, product brands and seller content remain the property of their respective owners.


20. Prohibited Conduct

Users may not:

  • Submit false or misleading information;

  • List unlawful, counterfeit or stolen products;

  • Infringe intellectual property rights;

  • Upload malicious software or code;

  • Attempt to gain unauthorised access to the website;

  • Interfere with website security;

  • Scrape or systematically extract website data without authorisation;

  • Use the platform to commit fraud;

  • Impersonate another person or business;

  • Harass or abuse other users;

  • Manipulate reviews, listings or website functionality; or

  • Use Bakkie Guys for unlawful purposes.

Accounts or listings involved in prohibited conduct may be restricted, suspended or terminated.


21. Marketplace Liability

Where Bakkie Guys acts only as an advertising platform or marketplace intermediary and a transaction is concluded directly between a buyer and an independent seller, Bakkie Guys is not the seller of the relevant product.

Subject to applicable law, Bakkie Guys is not responsible for acts or omissions of independent sellers, including:

  • Seller misconduct;

  • Failure to deliver;

  • Independent seller warranty disputes;

  • Incorrect information supplied by the seller;

  • Independent fitment services; or

  • Direct payments made outside the Bakkie Guys checkout system.

This limitation does not apply in the same manner where Bakkie Guys is itself the seller or contracting party.


22. Limitation of Liability

To the maximum extent permitted by South African law, Bakkie Guys will not be liable for indirect, incidental, special or consequential losses arising solely from the use or inability to use the website.

Nothing in these Terms excludes or limits liability where such liability cannot legally be excluded or limited.

In particular, nothing in these Terms is intended to exclude rights or remedies available to consumers under the Consumer Protection Act, 68 of 2008, POPIA or other applicable legislation.


23. Indemnity

To the extent permitted by law, users agree to indemnify Bakkie Guys against claims, losses or reasonable costs arising from the user’s:

  • Unlawful use of the platform;

  • Material breach of these Terms;

  • Fraudulent conduct;

  • Infringement of third-party intellectual property rights; or

  • Content uploaded without the necessary rights or authority.

This provision does not require a consumer to waive rights that cannot lawfully be waived.


24. Fraud and Security

Bakkie Guys reserves the right to perform reasonable verification and fraud-prevention checks.

Orders, accounts or transactions may be temporarily withheld while suspicious activity is investigated.

Where we reasonably suspect criminal or fraudulent activity, information may be provided to payment providers, financial institutions or appropriate authorities where permitted or required by law.

External websites operate independently from Bakkie Guys.

We are not responsible for the content, security, availability or privacy practices of independently operated third-party websites.


27. Changes to These Terms

Updated Terms will be published on the website together with a revised “Last Updated” date.

Changes will apply from the effective date stated in the updated Terms, subject to applicable law.


28. Governing Law

These Terms are governed by the laws of the Republic of South Africa.

Any dispute arising from the use of Bakkie Guys or these Terms will be dealt with under applicable South African law and through the courts or other dispute-resolution bodies having lawful jurisdiction.

Nothing in these Terms prevents a consumer from exercising rights available through the Consumer Goods and Services Ombud, National Consumer Commission, Information Regulator, or another competent regulatory body where applicable.
